Introduction

In order to foster a supportive environment for all our employees who are part of TVS Motor Company Ltd. as well as extending it to their families, we have established the “Maternity & Paternity Benefits - Policy”. We understand that the first one or two years, right from start of pregnancy till the first birthday of the child is a unique period where families undergo life changes alleviating their maternal as well as paternal instincts which require appropriate care and nourishment. The policy encompasses all strata of parenthood which would help in reducing the potential early challenges of child care while at work.

Definitions
- New Mother: A female employee / partner (primary care giver) who has either given birth to a child or has legally adopted a child or is a Commissioning Mother
- Commissioning Mother: A female employee / a partner (primary care giver) who engages a surrogate, to obtain a child as per legal provisions of India
- New Father: A male employee / partner (secondary care giver) whose spouse / partner (primary care giver) has either given birth to a child or has legally adopted a child or has obtained a child through surrogacy as per legal provisions of India
Maternity Policy:
Upto two (2) surviving children:
- The maximum period of maternity leave shall be thirty (30) weeks, inclusive of twenty six (26) weeks as per statutory requirement, including weekly offs and paid holidays
- Leave, entitled also includes one (1) month of leave to cater to any illness arising due to pregnancy
Beyond two (2) or more surviving children:
- The maximum period shall be twelve (12) weeks, including weekly offs and paid holidays
Onboarding Leave:
- In addition to the maternity leave, women employees would also be entitled for a Flexi working for a period of eight (8) Weeks
- Women employees are required to work a minimum of four and a half (4.5) hrs. of continuous working during the shift (excluding lunch)
- Onboarding leave shall not be split or carried forward i.e. if employee avail 4 weeks of onboarding leave and resumes for full day, she will not be entitled for remaining 4 week of onboarding leave
- It would be applicable from the day, women employee resumes her work
Early Confinement:
- Every new mother can apply for Maternity Leave for not more than eight (8) weeks preceding the date of the expected delivery for Upto two (2) surviving children / for not more than six (6) weeks beyond two (2) or more surviving children as the case may be (inclusive of Weekly offs and Paid Holidays)
Annual Leave:
- Annual Leave Entitlement continues as usual during the period of maternity leave
Miscarriage / Death:
- In case of an unfortunate incident such as miscarriage, abortion or termination of pregnancy on medical grounds, the woman employee shall be entitled for paid Maternity leave upto six (6) weeks
- In case of an unfortunate incident if a woman employee who dies during the maternity or her delivery or the period immediately following the date of her delivery, leaving behind in either case the child, maternity benefit for that entire period shall be payable. However, if the child also dies during the said period, then, Maternity benefit shall be payable for the days up to and including the date of the death of the child
Pay:
- Full salary would be paid during the period of maternity
Employment Protection:
- All women employees post maternity would be entitled to return to the same or equivalent job with no reduction in wages or benefits applicable to the role
- An employee who does not wish to return to work after maternity leave, must give the notice of termination of min three (3) months
Procedure:
- The employee can apply for a leave through Attendance Self Service System submit the same for approval
- The employee is required to furnish the following documents before proceeding on leave (Annexure attached)
- Notice of Maternity Benefit & Nomination
- Form B
- The employee is required to furnish the following documents on reporting back from Maternity leave:
- The birth certificate of the child
- Discharge card from the hospital after delivery of child
- Form B
- The following documents should be submitted in given cases below:
- Miscarriage or medical termination of pregnancy: Form B & Relevant Medical Reports
- Tubectomy operation: Form B & Relevant Medical Reports
- Illness arising from any of the above: Form B & Relevant Medical Reports
- In any of the above cases Form B has to be submitted to TVS Motor CMO for his approval along with relevant medical reports
- In case of delivery of a child or children or any pre-mature birth of a child or children, the employee will inform the Company within seven (7) days from the date of delivery, either through a letter or through e-mail giving reference of her employee number
- In case of miscarriage, medical termination of pregnancy, the woman employee or anyone representing her in the family shall inform the company in writing within two (2) days from the date of the incident
- Beneficiaries shall file an application to the Company in the form prescribed in the Maternity Benefits Program for payment of maternity benefits in the following manner:
- In case the woman employee proceeds on maternity leave, minimum one (1) week before her commencement of maternity leave
- In case of an unfortunate incident like death of the woman employee, within one (1) month from the date of death, the beneficiary shall file an application for claim of maternity benefits, enclosing the documents along with the application form prescribed

Guidelines:
- Women employees can avail their regular leave after the completion of Maternity leave, however the total leaves availed cannot exceed twelve (12) months
- The Maternity leave cannot be en-cashed

Paternity Policy
Towards promoting culture of inclusion and gender parity, TVS Motor Company Ltd. introduces Paternity Leave to focus towards both primary as well as secondary care givers and also to support them bond with the newborn.
- Duration: All eligible employees are entitled to a six (6) days of paid Paternity Leave
- In case of Miscarriage, all employees would be entitled to a four (4) days of paid Paternity leave
- Validity: The leave can be taken anytime during the duration of one (1) month prior or after the date of delivery of the child or date of adoption, and can be split in intervals within the time frame, if required
- Guidelines:
- The paternity leave shall be paid leave and will be over and above the Earned leaves & Paid Holidays
- The paternity leave cannot be carried forward post the validity period mentioned above and will lapse one (1) month after the date of birth or adoption of the child
- The paternity leave cannot be en-cashed
Adoption Policy:
TVS Motor also introduces Adoption Leave to enable parents to bond as well as support the transition of the new child to the family. The key differentiator in this policy is that it is gender neutral and the primary care giver whether male or female is eligible for paid leave.
Duration:
All eligible employees are entitled to Adoption leave as below:
- "Single parents” or the “Primary Caregiver” would be entitled for a leave of twelve (12) Weeks from the date the child is handed over. In addition, an Onboarding leave of eight (8) weeks with flexi timing as mentioned in maternity leave shall be applicable"
- A “Commissioning Mother” or “Adopting Mother” shall be entitled for a leave of twelve (12) Weeks, along with eight (8) weeks of Onboarding leave. All other guidelines would be applicable as mentioned in Maternity Leave
- An “Adopting Father” or “Secondary Caregiver” would be eligible for six (6) days of paternity leave as applicable
Guidelines
- The adoption leave shall be paid leave and will be over and above the Earned leaves
- The leave cannot be en-cashed or carried forward
- Employee shall submit all legal documents as applicable in the applicable by adoption law by the Indian government
